To guarantee a smooth cooperation with the company Stratos Swiss, based in Zurich ZH, Switzerland we ask you to read these terms and conditions. You automatically accept these terms and conditions when ordering products or using our services. Your non-compliance releases us from any obligations arising from existing orders and unfulfilled contracts.
- Conditions & Offers
The prices for services and products to be paid by the customer are set out in the contract or the corresponding price list. All prices are in Swiss Francs, EURO, or US Dollars and are exclusive of VAT. Place of performance is Zurich ZH. The freight and packaging costs are charged according to expenditure, even with subsequent deliveries. If the basis of calculation changes, we reserve the right to charge the prices valid on the delivery day. Special conditions and promotions on request, resp. according to special agreement. Our offers are confidential and may only be disclosed to persons who actually process our offers. Price changes and errors subject to change. - Delivery
The Stratos Swiss selects the mode of transport and shipping method. If the buyer / client requests deviating goods, he bears the additional costs. Partial deliveries are permitted. Unavoidable events such as force majeure, strikes, etc., entitle Stratos Swiss to delay delivery, if necessary to withdraw from the contract. With the delivery of goods to the buyer / client, the benefits and risks are transferred to him. All delivery dates are not binding. If the agreed credit limit is exceeded or if payment is delayed, we reserve the right to stop delivery immediately. - Terms of payment
Unless otherwise agreed, all invoices are in Swiss francs, EURO, resp. Payable in US dollars and within the agreed and printed on the invoice payment date, without deductions. Checks are only valid when redeemed as payment. The offsetting of counterclaims of the buyer is excluded. Claims asserted by the buyer from warranty or alleged defects do not exempt him from the obligation to pay. In deviation from the above terms of payment, Stratos Swiss reserves the right to deliver goods only in cash or in advance and by cash on delivery. This is especially true for customers who order for the first time at Stratos Swiss. Advance payments are not interest-bearing. Refusal of the acceptance of ordered goods does not release from the purchase price payment. All dunning and collection charges and special expenses in case of acceptance or default of payment shall be borne by the buyer. - Liability for defects & damages
Open defects must be reported immediately in writing, but at the latest within 3 days after receipt of the goods and returned within 5 (five) days, otherwise the goods are considered approved. The liability for the costs of disassembly or reassembly as well as damages that are directly or indirectly caused by the delivered goods (consequential damages) will be rejected. - Warranty
The warranty periods for the different product groups vary. Basically, we pass on the manufacturer’s warranty in full to our customers. If this information is missing, the warranty period is 1 year from the date of invoicing. Warranty claims will not be compensated with credits, unless otherwise agreed. Stratos Swiss will remedy any defectively defective material or defective defects during the warranty period free of charge, improve or replace defective parts. The warranty does not cover damage caused by improper handling, overload, force majeure or natural wear. The warranty excludes consumables. In addition, the warranty obligation shall cease to apply if changes or repairs have been made to the object of purchase without the consent of Stratos Swiss. Freight, shipping and insurance costs of repairs are borne by the customer. The material must be packed in such a way that no electrostatic or mechanical damage is possible. For repair shipments that are not carried out in appropriate packaging, we reserve the right to refuse the guarantee. For certain items, the warranty is provided directly by the manufacturer. - Repair conditions
Repairs will only be accepted with a correctly completed repair form (one form per article) and the corresponding invoice copy. To complete the repair form, the repair software must be downloaded from our website „www.website.ch“/reperaturen. Only the defective products without accessories will be accepted. For organizational reasons, any returned repair that arrives without a repair form or invoice copy will be returned to the sender. Submissions can only be accepted by specialist retailers for guarantee reasons. If sent items despite thorough examination do not have the fault described by them or fall under the warranty, we charge a fee of Fr. 38.- per 15 minutes working time. This also good for sent articles that were not purchased from Stratos Swiss. Basically, no Vorgarantieaustauschausche be made. For items that are no longer manufactured or not available, we must pass the manufacturer repair delivery time. Addition to electric scooter: Loss of warranty arises, by opening the housing, damage to the housing, when using on wet roads or rain. - Severability clause
If individual provisions of this contract prove to be invalid, ineffective or unsatisfactory, this shall not affect the validity, effectiveness and fulfillment of the remaining parts of the contract. In this case, the parties undertake to replace the invalid, ineffective or unenforceable part of the contract with a valid, effective and fulfillable provision that comes closest in content to the original intention of the parties. - Final provision
The customer acknowledges these terms and conditions in all points with each telephone, oral or written order. Place of jurisdiction for both parties is Zurich ZH. Only Swiss law applies. This edition of the Terms and Conditions replaces all previous ones.
